These Terms of Service govern your use of BeaconSeal™ and define the rights and responsibilities of schools, administrators, and users.

1. Acceptance of Terms

By accessing and using BeaconSeal™, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service. BeaconSeal™ reserves the right to modify these terms at any time. Continued use of the service following changes constitutes acceptance of the updated terms.

These terms apply to all users, including school administrators, teachers, staff, and any other authorized representatives accessing BeaconSeal™ on behalf of your school or district.

2. Service Description

BeaconSeal™ is a digital compliance platform designed to help schools meet state phone-free school laws. The service includes:

Student Device Management

Secure device sealing and compliance tracking during school hours

Administrator Dashboard

Real-time compliance metrics, incident logging, and audit trails

Emergency Access Controls

Authorized emergency exit procedures with automatic logging

Reporting & Compliance

Comprehensive audit trails and compliance reporting for state requirements

3. Acceptable Use Policy

You agree to use BeaconSeal™ only for lawful purposes and in accordance with these terms. You specifically agree not to:

Attempt to circumvent or disable security features or compliance controls
Use the service to harm, harass, or discriminate against any person
Attempt unauthorized access to accounts, systems, or data
Share login credentials or allow unauthorized users to access your account
Modify, reverse-engineer, or attempt to derive the source code or algorithms
Use the service in violation of any federal, state, or local law
Interfere with or disrupt the service or servers/networks connected to it

4. School & Administrator Responsibilities

As a school administrator, you are responsible for:

Account Management

Maintaining the confidentiality of login credentials and ensuring only authorized staff have access to your account

Compliance

Ensuring your use of BeaconSeal™ complies with all applicable federal, state, and local laws, including FERPA, COPPA, and state phone-free school laws

Student Consent

Obtaining appropriate parental/guardian consent for students under 18 before enrolling them in BeaconSeal™

Data Accuracy

Ensuring that student roster data and school information imported into BeaconSeal™ is accurate and current

Incident Response

Promptly investigating and responding to incidents logged in BeaconSeal™ and maintaining appropriate documentation

5. Service Availability & Uptime

BeaconSeal™ is hosted on Google Cloud Platform with a target uptime of 99.9%. However, we do not guarantee uninterrupted service. Scheduled maintenance windows may occur during off-school hours. We will provide advance notice of planned maintenance when possible.

In the event of service interruption, BeaconSeal™ will work to restore service as quickly as possible. We maintain backup systems and redundancy to minimize impact on school operations.

Emergency Access Procedures

If BeaconSeal™ becomes unavailable during school hours, students retain the ability to access devices through manual emergency procedures established by your school. All emergency access is logged and reported when service is restored.

6. Limitation of Liability

To the fullest extent permitted by law, BeaconSeal™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or information
  • Loss of revenue or profits
  • Business interruption
  • Reputational harm

BeaconSeal™'s total liability for any claim arising from these terms shall not exceed the amount paid by your school for the service in the 12 months preceding the claim.

Important Exception

This limitation does not apply to claims arising from BeaconSeal™'s gross negligence, willful misconduct, or violation of applicable privacy laws (FERPA, COPPA, GDPR, state privacy laws).

7. Data Ownership & Privacy

Your school retains full ownership of all student data, roster information, and compliance records. BeaconSeal™ acts as a data processor on behalf of your school. All data handling is governed by our separate Privacy Policy and complies with FERPA, COPPA, GDPR, and applicable state privacy laws.

You may request deletion of your school's data at any time. Upon termination of service, all student data will be deleted within 90 days, except where retention is required by law.

8. Intellectual Property

BeaconSeal™, including all software, features, functionality, design, and content, is owned by BeaconSeal LLC and protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use BeaconSeal™ solely for your school's compliance purposes.

You may not reproduce, distribute, modify, or create derivative works based on BeaconSeal™ without explicit written permission from BeaconSeal LLC

9. Termination of Service

Your school may terminate its BeaconSeal™ subscription at any time by providing written notice. BeaconSeal™ may terminate service if:

  • You violate these Terms of Service
  • You fail to pay subscription fees
  • You use the service in violation of applicable law
  • We determine that continued service poses a security or legal risk

Upon termination, your access to BeaconSeal™ will be immediately revoked. Your student data will be deleted within 90 days, except where retention is required by law.

10. Indemnification

Your school agrees to indemnify and hold harmless BeaconSeal LLC from any claims, damages, or expenses arising from your use of BeaconSeal™ in violation of these terms or applicable law, or from any breach of your responsibilities under Section 4.

11. Dispute Resolution

Any disputes arising from these Terms of Service shall first be addressed through good-faith negotiation between your school and BeaconSeal™. If negotiation fails, disputes shall be governed by the laws of the United States and resolved through binding arbitration.

Both parties waive the right to jury trial and class action litigation. Arbitration shall be conducted in accordance with the American Arbitration Association (AAA) rules.

12. Changes to These Terms

BeaconSeal™ may modify these Terms of Service at any time. Material changes will be communicated to your school via email at least 30 days before taking effect. Continued use of the service following notification of changes constitutes acceptance of the updated terms.

If you do not agree with changes to these terms, your school may terminate the service without penalty during the 30-day notice period.
